Permanent Residency (commonly referred to as Green Card in U.S.) is issued first and then subsequently, citizenship is granted to the applicants under the Naturalization and Citizenship laws of both the countries, U.S. and Canada. In order to become eligible to apply for the citizenship, the applicant must fulfil the required conditions such as minimum residency requirements in the country etc. This same general principle is followed under most of the immigration or visa categories.

U.S.A – The applicant who has acquired the U.S. Green Card must hold the Green Card for at least five years and stay in the U.S. for a minimum period of 2.5 years during these 5 years. After that only, such an applicant becomes eligible to apply for the U.S. citizenship.

Canada – The applicant who has acquired the Canadian Permanent Residency must stay for a minimum period of three years in Canada on the Permanent Residency, and then only such an applicant becomes eligible to apply for the Canadian citizenship.

U.S. Green Card offers numerous benefits and rights to the holders. As a Green Card holder or U.S. Permanent Resident, you have a right to enter United State visa free and you can live and work in the U.S. without the requirement to obtain any additional residency visa or work permit. Children of Green card holders can avail the benefits of free public education at public schools, and college aged children have access to numerous scholarships and grants, and can enjoy discounted tuition fee rates at public postsecondary institutions.

 

Additionally, Green Card provides unlimited working rights to the holders where they can work with any employer or run their own business without any requirement of obtaining any additional employment authorization. Due to impending challenges associated with H1-B visas, corporations and employers often prefer Green Card holders or U.S. citizens over other international students, due to which the chances of securing internships and jobs increase significantly.

U.S. Green Card / Permanent Residency doesn’t require you to be present in the U.S. throughout the entire 365 days period of a year, in fact, it offers flexibility of maintaining residency of other country simultaneously. Your Green Card will remain active as long as you have intent to make and call United States as your permanent home and you land in the U.S. after every 6 months.

Additionally, Permanent Residency provides unlimited and unrestricted working rights where the Permanent Residents can work with any employer or operate their own business without any requirement of obtaining any additional employment authorization. Due to impending challenges associated with work permits and LMIA, corporations and employers often prefer Permanent Residents or Canadian citizens over other international students and professionals, due to which the chances of securing internships and jobs increase significantly.

Canadian Permanent Residency also provides access to universal public healthcare system of Canada. Canada offers free healthcare facilities to its Permanent Residents and citizens along with other social security benefits.

The path to passport or citizenship is shorter in Canada, as the Permanent Residents can apply for passport or citizenship immediately after completing 3 years of stay in Canada. They are not required to wait for any additional time.

All countries have some similarities and differentiations in their taxation systems. Likewise, both the U.S. and Canada have worldwide taxation and subject their Permanent Residents (referred to as Green card holders in the U.S.) and citizens to worldwide taxation. However, there is still some stark difference in the scope of worldwide taxation emplyed by both the countries. Non-residents Permanent Residents or citizens are not taxed in Canada on their income earned abroad, whereas, in contrast, the USA subjects Green Card holders and citizens to worldwide taxation regardless of their residency status in USA.

Thus, tax is charged in the U.S. even on the income earned abroad by the U.S. Green Card holders and citizens.

In Canada, residents are subject to both federal and provincial/territorial income taxes, with varying rates across provinces. The United States imposes federal income tax, and similarly, individual states have their own income tax rates, with some states not levying a state income tax at all. U.S. and Canada implement progressive tax system, but specific tax rates differ according to the income bracket of taxpayers, and income thresholds.

In terms of indirect taxes, Canada applies Good and Services Tax (GST) or Harmonised Sales Tax (HST), while USA applies state-specific sales tax on goods and services. It is imperative to keep yourself aligned with the updated tax norms by consulting tax experts from time to time.

Language requirements differ from country to country and also, depend on the immigration route that you are opting for. Under one immigration program there might be a very stringent requirement for language skills, while under the other immigration program, this requirement might not be there.

For instance, the U.S. EB-5 Immigrant Investor Program is a very popular direct Green Card program for the U.S. where there is no such requirement of any language skills. Person of any nationality can apply under this program and there are no education, skills and/or profession related requirements. As long as you are able to invest minimum $800,000 USD in the U.S. derived from a legitimate source of income in accordance with the given rules and regulations of the EB-5 program, you qualify under the EB-5 program.

In the same way, Canada has different language requirements under the different immigration streams. The direct Permanent Residency program of Start-up visa has a minimal language skills requirement of 5 CLB score in IELTS, which is very basic and easily achievable by anyone who understands the English language.
